On May 2, 2019, Pinnacle Bank filed a formal complaint against Harkers Island Sewer Company (HISC) detailing a dispute regarding HISC’s obligation to provide wastewater services to James Creek Subdivision.

On December 30, 2019, the James Creek Subdivision was sold to MRT-1, LLC. On April 9, 2020, MRT-1, LLC asked to replace Pinnacle Bank in this proceeding, which the Commission allowed on October 22, 2020.

Because attempts at mediation have not resolved this matter, the Commission has scheduled an evidentiary hearing to begin at 10:00 a.m., August 17, 2022. This hearing is for the purpose of receiving evidence from the parties regarding this complaint. The hearing will be held in Room 2115 of the Dobbs Building, 430 N Salisbury, Raleigh.

The Public Staff of the North Carolina Utilities Commission investigates utility matters and advocates on behalf of utility consumers in matters before the Commission. The Public Staff filed its recommendation in this matter on December 9, 2021.
